Interesting. In the UK I think you might have had a claim on the basis that the bike was not of merchantable quality. I've no idea what consumer law is like over your way.
However, you did well getting a BMW dealer to admit to a "known problem". Despite all the info available on the net the usual tack is to deny all knowledge of any such issues. Indeed, I was told by a dealer technician that this is the line they are instructed to take by the importer.
